These Terms of Use govern your use of bioformrx.com/, the BioForm Rx patient portal, and the services we provide (together, the "Services"). By using the Services you agree to these terms, our Privacy Policy, our Telehealth Consent and our Subscription and Refund Policy. If you do not agree, do not use the Services.
Who we are and what we do
BioForm Rx is a telehealth medical practice operated by The Tide Clinic PLLC, a physician-owned Texas professional limited liability company. Medical services are provided only by physicians, nurse practitioners and physician assistants licensed in the state where you are located at the time of your visit. Our providers exercise independent medical judgment; no one other than a licensed provider makes treatment decisions. Management, technology and administrative services are provided to the practice by a separate management company, which does not practice medicine.
Eligibility
- You must be at least 18 years old and physically located in a state where we are licensed to provide care. Our current service states are listed on our website and confirmed during the eligibility check.
- You must provide accurate, complete and current information about yourself, including your identity, medical history and medications, and update it when it changes.
- You may use the Services only for yourself. You may not create an account for another person or obtain medication for anyone else.
Medical services and prescriptions
- Completing an intake or purchasing a plan does not guarantee that you will receive a prescription. Every prescribing decision is made by a licensed provider after reviewing your evaluation, medical history and lab results. Some treatments require a live video visit.
- Prescriptions are issued only when medically appropriate and only for the patient evaluated. Medications, including compounded medications, are dispensed by licensed pharmacies, and you may choose any licensed pharmacy as described in our Pharmacy Choice Disclosure.
- Compounded medications are prepared for an individual patient by a licensed pharmacy when a provider determines that a compounded formulation is appropriate for that patient. Compounded medications are not FDA-approved and have not been evaluated by the FDA for safety, effectiveness or quality.
- We do not provide emergency care. If you have a medical emergency, call 911 or go to the nearest emergency room.
- Information on our website, including articles in our Learn section, is for general education and is not medical advice, does not create a provider-patient relationship, and is not a substitute for a consultation with a licensed provider.
Accounts and security
You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at support@bioformrx.com if you suspect unauthorized access.
Payment
Plan fees, medication charges and lab fees are described at signup and in our Subscription and Refund Policy. Plans renew automatically until cancelled. By providing a payment method you authorize us and our payment processor to charge the amounts you agreed to.
Acceptable use
You agree not to misuse the Services, including by providing false information, impersonating another person, attempting to obtain medication for resale or for another person, interfering with the Services’ security, scraping content, or using the Services in violation of any law. We may suspend or terminate accounts that violate these terms.
Intellectual property
The Services and their content are owned by The Tide Clinic PLLC or its licensors and are protected by copyright, trademark and other laws. BioForm Rx and the BioForm Rx logo are our trademarks. You may use the Services for your personal, non-commercial use only.
Disclaimers
Except as expressly stated, the Services are provided “as is” without warranties of any kind. We do not guarantee any particular health outcome. Individual results vary.
Limitation of liability
To the fullest extent permitted by law, The Tide Clinic PLLC and its owners, officers, providers, employees and contractors will not be liable for indirect, incidental, special or consequential damages arising from your use of the Services. Nothing in these terms limits liability for professional negligence in the provision of medical care or any liability that cannot be limited by law.
Governing law and disputes
These terms are governed by the laws of the State of Texas without regard to conflict-of-law rules. Any dispute arising from these terms or the Services will be brought in the state or federal courts located in Harris County, Texas, and you consent to their jurisdiction. Claims relating to medical care are subject to applicable Texas and state healthcare liability laws.
Complaints and licensing information
To file a complaint about a Texas physician or to obtain information about licensing, contact the Texas Medical Board, 1801 Congress Avenue, Suite 9.200, Austin, TX 78701, 1-800-201-9353, www.tmb.state.tx.us. Contact information for the medical board in your state is available on request.
Changes
We may update these terms by posting a revised version with a new effective date. Continued use of the Services after changes take effect means you accept them.
