This Privacy Policy explains how BioForm Rx collects, uses and shares information when you visit bioformrx.com/, use our patient portal, or communicate with us. Health information that we collect as a healthcare provider is governed by the Health Insurance Portability and Accountability Act (HIPAA) and is described in our Notice of Privacy Practices. Where this policy and the Notice of Privacy Practices overlap, the Notice controls for protected health information.
Information we collect
- Information you give us. Your name, email address, phone number, shipping address, date of birth, state of residence, payment card details (processed by our payment processor; we do not store full card numbers), answers to our eligibility check, and anything you send us by email, chat or the patient portal.
- Health information. Medical history, symptoms, medications, lab results, identification documents and other information you provide during intake or treatment. This information is collected through our HIPAA-compliant intake and clinical systems and is handled as protected health information under our Notice of Privacy Practices.
- Information collected automatically. IP address, browser and device type, pages viewed, referring pages, and approximate location, collected through cookies and similar technologies described below.
How we use information
- To determine whether you are eligible for our services in your state and to deliver medical care through licensed providers.
- To process payments, fulfill prescriptions through the pharmacy you select, and ship medication and lab kits.
- To communicate with you about your care, your account, appointments, billing and policy changes.
- To operate, secure and improve our website and services.
- To send marketing communications about our services, only where permitted and only until you opt out.
- To comply with legal obligations and enforce our Terms of Use.
Cookies, analytics and advertising
We use cookies and similar technologies for essential site functions, analytics and advertising measurement. We do not place advertising or analytics tags on intake forms, the patient portal, or pages that would reveal your health condition, and conversion events we send to advertising platforms do not include health information. You can control cookies through your browser settings; disabling cookies may affect site functionality.
How we share information
- Service providers that host our website, process payments, deliver email, provide intake and clinical software, ship packages, or perform analytics, under contracts that restrict their use of your information. Vendors that handle health information sign business associate agreements with us.
- Pharmacies and laboratories involved in your care, as described in our Pharmacy Choice Disclosure.
- Legal and safety disclosures when required by law, to respond to legal process, or to protect the rights, safety or property of patients, the public or BioForm Rx.
- Business transfers in connection with a merger, acquisition or sale of assets, subject to this policy.
We do not sell your personal information, and we do not share health information for advertising purposes.
Your choices and rights
You can update your account information through the patient portal, opt out of marketing emails using the unsubscribe link in any message, and opt out of marketing text messages by replying STOP. Depending on your state, you may have the right to access, correct or delete personal information we hold about you, to obtain a copy of it, and to appeal a decision we make on your request. Texas residents have these rights under the Texas Data Privacy and Security Act; California residents have similar rights under the California Consumer Privacy Act. To exercise these rights, email privacy@bioformrx.com. We will verify your identity before responding and will respond within the time required by law. Rights regarding protected health information are described in our Notice of Privacy Practices.
Security
We use administrative, technical and physical safeguards designed to protect your information, including encryption in transit and at rest, access controls and staff training. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Children
Our services are available only to adults 18 and older. We do not knowingly collect information from anyone under 18. If you believe a minor has provided us information, contact privacy@bioformrx.com and we will delete it.
Data retention
We keep personal information for as long as needed to provide our services and meet legal, regulatory and record-keeping requirements. Medical records are retained for the periods required by Texas law and the laws of the states in which we practice.
Changes to this policy
We may update this policy from time to time. We will post the updated policy on this page with a new effective date and, for material changes, notify you by email or through the patient portal.
